Terms of Service

By accessing or using AutoPublish ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
1. Description of Service
AutoPublish is a Software-as-a-Service (SaaS) platform that uses artificial intelligence to generate SEO-optimized blog content and publish it to WordPress websites via the WordPress REST API. The Service is intended for marketing agencies and individuals managing one or more WordPress sites.
2. Account Registration
To use AutoPublish, you must create an account with a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
You must be at least 18 years old to use the Service.
By creating an account, you consent to the collection and use of your personal information in accordance with our Privacy Policy. If you are located in Canada, this processing is governed by the Personal Information Protection and Electronic Documents Act (PIPEDA).
3. Acceptable Use
You agree not to use AutoPublish to:
- Generate content that violates applicable laws or regulations
- Produce spam, misleading content, or content intended to deceive readers
- Publish to websites without authorization from the site owner
- Generate content that infringes on third-party intellectual property rights
- Attempt to circumvent Google's Webmaster Guidelines in a deceptive manner
- Resell or sublicense access to the Service without written permission
- Use the Service to harm, harass, or defraud others
We reserve the right to suspend accounts that violate these terms without notice or refund.
3a. AI Content Disclosure
AutoPublish generates content using artificial intelligence. You acknowledge that:
- Content published through AutoPublish may be AI-generated. You are responsible for disclosing this where required by law (including FTC guidelines in the US) or platform policies.
- You must not use AutoPublish to generate content that makes false medical, legal, or financial claims.
- You must not use AutoPublish to generate content that impersonates real individuals or organisations.
- You must not generate content involving child sexual abuse material (CSAM), hate speech, or content inciting violence. Violation results in immediate account termination and reporting to relevant authorities.
4. Content Ownership and Responsibility
All content generated by AutoPublish on your behalf is owned by you. You are solely responsible for:
- The accuracy and legality of content published to your WordPress sites
- Reviewing AI-generated content before publication (or accepting responsibility for auto-published content)
- Ensuring the content complies with the terms of service of WordPress and any third-party platforms
- Any claims arising from the content published using AutoPublish
AutoPublish is a tool, not a publisher. We do not review content before it is published.
5. Billing and Payment
AutoPublish is a subscription-based service billed monthly or annually via Stripe. By subscribing, you authorize recurring charges to your payment method.
- Free tier: All new accounts receive 3 free credits. No credit card required.
- Cancellation: You may cancel at any time. Your access continues until the end of the current billing period.
- Refunds: We offer a 14-day money-back guarantee on first purchases. Subsequent periods are non-refundable.
- Plan changes: Upgrades take effect immediately. Downgrades take effect at the next billing cycle.
6. Service Availability
We aim for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for losses resulting from service downtime or interruptions.
7. Third-Party Services
AutoPublish integrates with third-party services including OpenAI, Pexels, Supabase, and Stripe. Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for the actions or availability of third-party services.
8. AI-Generated Content Disclaimer
AutoPublish uses large language models (LLMs) to generate content. You acknowledge and agree that:
- AI-generated content may contain factual errors, hallucinations, outdated information, or inaccuracies. You are responsible for reviewing and verifying all content before publication.
- AutoPublish makes no representation that AI-generated content is accurate, complete, or suitable for any particular purpose.
- AutoPublish is not liable for any losses, damages, legal claims, or reputational harm arising from the publication of inaccurate or misleading AI-generated content.
- You are solely responsible for any content published to your WordPress sites through the Service, including compliance with applicable laws (including but not limited to FTC disclosure requirements for AI-generated or sponsored content).
9. DMCA and Copyright
AutoPublish respects intellectual property rights. If you believe that content generated or published through our Service infringes your copyright, please send a DMCA takedown notice to:
[email protected] with the subject line "DMCA Takedown Notice"
Your notice must include: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and its location; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy under penalty of perjury; and (6) your signature (electronic or physical).
We will respond to valid DMCA notices within 14 business days.
10. Indemnification
You agree to indemnify, defend, and hold harmless AutoPublish, its operators, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service or violation of these Terms
- Content published to your WordPress sites through the Service
- Your violation of any third-party rights, including intellectual property rights
- Any claim by a third party that your use of the Service caused them harm
11. Confidentiality
Each party agrees to keep confidential all non-public information received from the other party in connection with the Service. You agree not to disclose AutoPublish's non-public technical documentation, internal pricing structures, or proprietary methodologies to third parties without prior written consent. This obligation survives termination of your account.
12. Force Majeure
AutoPublish is not liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, government action, internet infrastructure failure, third-party API outages (including OpenAI or Pexels), or labor disputes. We will make reasonable efforts to resume normal service as quickly as possible following such events.
13. Dispute Resolution
Before initiating any formal legal proceeding, you agree to contact us at [email protected] and provide written notice of your dispute. We will attempt to resolve the dispute informally within 30 days. If we cannot resolve the dispute informally, either party may pursue formal legal remedies as set out in the Governing Law section.
You agree that any claim against AutoPublish must be brought individually and not as part of a class action, class arbitration, or other representative proceeding.
14. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AutoPublish with respect to the Service and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that AI-generated content will be accurate, free of errors, or suitable for any particular purpose. We do not guarantee that content generated by AutoPublish will rank in search engines or achieve specific traffic results.
16. Limitation of Liability
To the maximum extent permitted by law, AutoPublish and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, or damage to your website or business reputation.
Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.
17. Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms. Upon termination, your access to the Service will cease immediately. Content already published to your WordPress sites will not be removed.
18. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or a notice in the dashboard. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
19. Governing Law
These terms are governed by the laws of Ontario, Canada. Any disputes arising from these terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Ontario.
